Eterna Law succeds in arbitration

Kyiv, January 26th - Eterna Law has successfully defended a Polish company client in a dispute against a major Ukrainian sunflower seed producer. The dispute arose out of the Ukrainian company’s ungrounded retention of prepayments under supply contracts.

 Our client initiated a number of arbitration proceedings before the ICAC at the Ukrainian Chamber of Commerce and Industry. In the course of the arbitration, the tribunal addressed how the UN Convention on Contracts for the International Sale of Goods and Ukrainian legislation apply and interrelate in the context of prepayment refunds.

 Despite the respondent’s dilatory tactics, Eterna Law reached a positive outcome for the client — the claims were allowed in full and the client was awarded about USD350,000.
