Kyiv, December 11 - Eterna Law successfully represented interests of one of the largest foreign companies in the field of aviation leasing in the process of recognition and enforcing the decision of the International Commercial Arbitration Court.
In connection with the refusal of the contractor's voluntary performance of the arbitral award, Eterna Law initiated a legal process for its recognition and enforcement in one of the district courts of the city of the Dnieper. During the consideration of this case by the district court, as well as the court of appeal, special attention was paid to the application of the New York Convention of 1958, as well as to the provisions of Ukrainian legislation regarding the recognition and enforcement of arbitral awards.
Despite the respondent's attempts to challenge the legality of the arbitral award, the Eterna Law team of lawyers achieved a positive result for the Client - the petition was satisfied in full, with the respondent recovering about six and a half million hryvnias.
