Eterna Law has successfully represented the significant Swiss soft commodities trader in FOSFA arbitration against another Swiss soft commodities trader owned by a high net-worth individual arising out of the sunflower shipment contract. This arbitration was complicated by the bankruptcy of the opposing party, which resulted from a conflict between its owners and former top managers.

In this English law-governed arbitration, Eterna Law's lawyers analysed issues of the contract's validity, the moment of its conclusion, its anticipatory breach and the need to suspend litigation in Switzerland until the end of arbitration. As a result, Eterna Law's team has presented strong arguments before arbitrators; they accepted these arguments and rendered an award in favour of Eterna Law's client.
