The EU established contractual relations with Ukraine within the framework of the Hague Convention

On April 24, the Council of the European Union established treaty relations with Ukraine in the framework of the Hague Convention on the Recognition and Enforcement of Foreign Judgments in Civil or Commercial Matters of 2019 (so-called Judgments Convention).
 
ETERNA LAW’s International Litigation Counsel, Kristina Shapovalova, explains what to expect as a result of joining the Convention:
"Ukraine became one of the first signatory countries. The Convention is currently ratified by Ukraine and the EU. As of 1 September 2023, Ukrainian decisions, as well as decisions of EU countries in civil and commercial matters, will be subject to mutual recognition and enforcement.
 
A Ukrainian court decision, which has entered into force under Ukrainian Law, is recognized by the EU on the basis of a relevant application.
 
The Convention unifies the standards of recognition of court decisions between Ukraine and EU countries, including those that did not have bilateral agreements with Ukraine.
 
It is expected that the list of participating countries will increase. This expands the boundaries for the real enforcement of Ukrainian decisions."
