ETERNA LAW team of lawyers represented the interests of a foreign investment fund in relations with Ukrainian borrowers, namely a group of sustainable companies operating in the Ukrainian agricultural market.
At the stage of project preparation, ETERNA LAW team was involved in a comprehensive due diligence of the current state of all assets of the borrowers’ group of companies that could be pledged (mortgaged).
To ensure the fulfillment of the borrowers’ obligations, a set of agreements was drafted regarding a pool of tangible assets owned by the borrowers, including a pledge of future crops, a pledge of corporate rights, a pledge of property rights to cash held in a bank account, a deed of assignment under a number of agreements with third parties, and a multilateral suretyship.
