On March, 15 Kristina Shapovalova, Senior Associate, took part in Legal High School Discussion Hub according perspectives of specialized financial court’s creation. Experts discussed perspectives of specialized financial court’s creation. The focus was on experience of foreign courts, credit disputes in Ukraine, alternatives to improve judicial protection of creditors’ interests, etc.
Assessing the practice of foreign financial courts, Kristina Shapovalova, lawyer of ETERNA LAW, spoke about the structure and activities of the Financial Court of Germany and noted that more interesting example of a specialized court is the mortgage court in Spain, which was established as a result of a decisional law of Spanish Supreme Court in 2015, when a decision was made on the claim of borrowers who considered unfair the terms of mortgage agreements.
