Anton Khodosh, Senior Lawyer at ETERNA LAW, spoke as a guest speaker as part of the SEED 5.0 project — an educational and grant-based initiative of the UN Global Compact in Ukraine, set up to support micro and small agribusinesses.
Anton Khodosh delivered a lecture on ‘Intellectual Property Agreements’ to participants in the fifth cohort of SEED, during which he shared practical advice on drafting and analysing such agreements.
During the meeting, the following topics were discussed:
- why it is important, before concluding a contract, to clearly define its subject matter and verify the legal status of the intellectual property, in particular the existence of state registration of trade marks, inventions and utility models;
- why it is the content of the contract, rather than its title, that determines the legal nature of the document, and how imprecise terminology can complicate the protection of the parties’ rights;
- how to correctly define the methods of using intellectual property, particularly in bilingual contracts, where an inaccurate translation may affect the scope of the rights granted;
- why the term of the contract must be aligned with the term of legal protection for the intellectual property, and why the transfer of property rights to intellectual property that is still in the development stage must be regulated in advance.
Anton Khodosh’s participation as a speaker formed part of a series of lectures by leading experts in the Ukrainian market, aimed at enhancing legal awareness and the sustainable development of entrepreneurs.
The project is being implemented by the UN Global Compact in Ukraine with the support of PepsiCo Ukraine and funding from the PepsiCo Foundation.
