Kyiv, 17th February. Eterna Law has successfully defended a leading European manufacturer of vitamins, feeds and pharmaceutical products in a dispute against a Ukrainian counterparty. Eterna Law initiate proceedings before the Commercial Court of the Zhytomyr Region due to the counterparty’s default under the supply contract.
A supply contract between the parties contained an arbitration clause that appeared to be a major challenge in the course of the proceedings. But Eterna managed to persuade the court that the arbitration clause was unenforceable. Also, our team proved that the Ukrainian company had failed to pay for the goods supplied.
Another aspect of the proceedings was that the court dealt with the case under Polish law that was interpreted in a legal opinion prepared by a Polish attorney. As a result, Eterna Law has reached a positive outcome for the client — the claim was allowed in full.
