ETERNA LAW TEAM HAS SUCCESSFULLY DEFENDED THE INTERESTS OF A WELL-KNOWN UKRAINIAN FREIGHT FORWARDING AND STEVEDORING COMPANY IN A DISPUTE AGAINST THE AGGRESSOR STATE

ETERNA LAW team has successfully defended the interests of one of the largest freight forwarding and stevedoring companies in Ukraine in the dispute against the aggressor state for damages. The company was forced to stop its cargo transshipment activities, was deprived of the opportunity to fulfill long-term contracts due to the blocking of vessel traffic, the suspension of the functioning of the Mykolaiv Sea Trade Port and constant shelling by the Russian Federation, and as a result suffered significant damages in the form of lost profits in the amount of more than USD 10 million.

In this dispute, ETERNA LAW lawyers developed and implemented the full range of necessary procedural actions, in particular: they collected and thoroughly analyzed the necessary evidence base to prove that the lost profits and their amount are real and reasonable, as well as the causal link between the lost profits and the aggressor’s unlawful behavior. In addition to the proper legal justification of the client’s position, ETERNA LAW lawyers also applied a comprehensive approach to notifying the aggressor state of the case hearing. As a result of the hearing, the court satisfied the client’s claims in full.

The team of ETERNA LAW’s International Litigation and International War-Damages Compensation practices worked on the project: associates Artur Koval, Oleksiy Metel, Vladyslav Holubokov and junior associate Vladyslav Korsakov under the guidance of counsels Kristina Shapovalova, Lidiya Zhovtyak and ETERNA LAW partner Oleg Beketov.
